1. Accepting these terms
These terms of service ("Terms") are an agreement between you and Blue Orbit Labs ("Blue Orbit Labs", "we", "us"). They apply to our mobile games and applications (the "Apps") and to this website (together, the "Services").
By downloading, installing or using the Services, you agree to these Terms and to our privacy policy. If you do not agree, do not use the Services.
2. Who can use our apps
You must be old enough to agree to these Terms in your country, or have permission from a parent or legal guardian who agrees to them on your behalf. Parents and guardians are responsible for how their children use the Services, including any purchases.
3. Your license
We give you a personal, limited, non-exclusive, non-transferable and revocable license to download and use the Apps on devices you own or control, for your own non-commercial entertainment or personal use, in line with these Terms and the rules of the app store you downloaded them from.
You may not:
- copy, modify, sell, rent or distribute the Apps or any part of them;
- reverse engineer, decompile or try to extract source code, except where the law allows this;
- remove copyright notices or other proprietary markings.
4. Purchases and virtual items
Some Apps are paid, and some offer in-app purchases such as virtual currency, items or ad removal ("Virtual Items"). All payments are processed by the app store, and the store's payment terms apply.
- Virtual Items have no real-world monetary value and cannot be exchanged for cash or transferred outside the App.
- When you buy a Virtual Item, you receive a license to use it within the App, not ownership of it.
- Refund requests are handled by the app store under its refund policy. Nothing in these Terms limits any refund rights you have by law.
- Prices are shown in the store before you confirm a purchase.
5. Advertising
Free Apps may display advertising from third parties. We are not responsible for the content of third-party ads or for products and services advertised. How advertising uses data is explained in our privacy policy.
6. Acceptable use
When using the Services, you agree not to:
- cheat, exploit bugs, or use bots, hacks or unauthorized third-party software;
- interfere with or disrupt the Services, servers or networks;
- try to gain unauthorized access to any part of the Services or other users' data;
- use the Services for anything unlawful, harmful or fraudulent;
- harass, threaten or abuse other people, where an App includes features to interact with others.
If you find a bug, please report it to us rather than exploiting it.
7. Your content and feedback
If an App lets you create or share content, you keep any rights you have in it, and you give us a worldwide, royalty-free license to host and display it as needed to run the App. You are responsible for making sure you have the right to share it.
If you send us ideas or feedback, we may use them to improve our Services without any obligation to you.
8. Intellectual property
The Services, including their code, artwork, characters, music, text and the Blue Orbit Labs name and logo, are owned by Blue Orbit Labs or its licensors and are protected by copyright, trademark and other laws. Except for the license in section 3, these Terms do not give you any rights in them.
9. Third-party services
The Services may include or link to services provided by others, such as app stores, ad networks and analytics providers. Their own terms and privacy policies apply, and we are not responsible for them.
10. Updates and availability
We may update, change or remove features of the Apps at any time, for example to fix bugs or improve performance. Some updates may be required to keep using an App. We may also stop offering or supporting an App. If we do, we will try to give reasonable notice where practical.
11. Disclaimer
The Services are provided "as is" and "as available". To the fullest extent allowed by law, we do not give any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted, error-free or compatible with every device.
12. Limitation of liability
To the fullest extent allowed by law, Blue Orbit Labs will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Services.
Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the relevant App in the 12 months before the claim, or USD 50.
Some countries do not allow these limitations, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
13. Termination
You can stop using the Services at any time by uninstalling the Apps. We may suspend or end your access if you seriously or repeatedly break these Terms. Sections 7, 8, 11, 12 and 14 continue to apply after termination.
14. Governing law
These Terms are governed by the laws of the country in which Blue Orbit Labs is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts where the law allows.
15. Changes to these terms
We may update these Terms from time to time. We will post the new version on this page and change the effective date. If you keep using the Services after changes take effect, you accept the updated Terms.
